TERMS & CONDITIONS - TRAZO: GOLF BALL TRACER

These Terms and Conditions ("Terms") govern your access to and use of Trazo: Golf Ball Tracer (the "App"). By downloading, installing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. ELIGIBILITY AND LICENSE
You must be able to form a binding contract in your jurisdiction and comply with these Terms. Subject to your compliance, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your own personal, noncommercial purposes.
If you wish to use traces created with the App in commercial content - for example in paid advertising, sponsored posts, coaching products, or broadcast material - you may do so provided you comply with Section 8 and do not present the App's output as a measurement, launch monitor reading, or certified performance data.
2. ACCOUNT AND ACCESS
The App may be used without creating an account. Certain features require enabling device permissions such as photo library, camera, and microphone access. You are responsible for your device and for maintaining the confidentiality and security of the videos and data stored on it.
3. YOUR CONTENT AND PERMISSIONS
You retain full ownership of the videos you import or record and the traced videos you export ("User Content"). You represent that you have the necessary rights to the footage you use and that it does not infringe any third-party rights.
All processing happens on your device. We do not receive, store, transmit, or have access to your videos, and we therefore claim no license of any kind over your User Content. We cannot view, recover, restore, or delete your videos on your behalf.
You are responsible for backing up your own footage. Deleting the App removes its stored data from your device.
4. FILMING OTHER PEOPLE
You are solely responsible for ensuring you have the right to record, trace, and share video containing other people. Recording and publishing footage of identifiable individuals may require their consent under privacy, data protection, or personality rights laws in your jurisdiction, and may be restricted by the rules of the golf course or facility where you are filming. We are not responsible for your compliance with those requirements.
5. THIRD-PARTY SERVICES
The App uses third-party services including Apple (App Store and in-app purchases), Google Firebase (analytics and crash reporting), Meta (advertising measurement), and Superwall (subscription screens). Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services. Details of what each receives are set out in our Privacy Policy.
6. NOT A MEASUREMENT OR LAUNCH MONITOR SERVICE
The App is a video effect tool. It draws a visual representation of a golf ball's flight path based on automated detection and geometric modelling of your footage.
The App does not measure and does not report carry distance, total distance, ball speed, club head speed, spin rate, spin axis, launch angle, apex height, smash factor, or any other performance metric. It is not a launch monitor, radar, camera-based ball tracking system, or measurement device, and it is not a substitute for one.
The traced arc is a visual approximation. Its accuracy depends on lighting, background, camera angle, frame rate, camera movement, and how clearly the ball is visible in your footage. Traces may be inaccurate, incomplete, or visibly wrong, particularly where the ball leaves the frame, is obscured, or is too small to detect. The App provides a manual mode precisely because automatic detection will not always succeed.
Where the App draws a portion of the flight path that was not directly detected - including the launch ramp, the descent, and the landing point - that portion is a model-based estimate, not an observation.
7. NO COACHING, PERFORMANCE, OR COMPETITIVE USE
Output from the App is for entertainment and personal reference only. It is not golf instruction, coaching advice, club fitting guidance, or performance analysis, and it must not be relied upon for equipment decisions, handicap purposes, wagering, competitive scoring, dispute resolution, or officiating. You are solely responsible for any decision you make based on the App's output.
8. YOUR RESPONSIBILITIES
You are solely responsible for:
a) the legality of the footage you record, import, and share, including obtaining any consents required from people appearing in it;
b) complying with the rules and filming policies of any course, range, or facility where you record;
c) not presenting traced output as measured or certified performance data;
d) complying with applicable laws and third-party rights, including the trademarks and image rights of any course, brand, or person visible in your footage.
You agree not to misuse the App, attempt to reverse engineer, decompile, or extract the machine-learning models or algorithms contained in it, circumvent subscription controls, or use the App to build a competing product, dataset, or service.
9. INTELLECTUAL PROPERTY
The App, its design, code, machine-learning models, arc styles, trademarks, logos, and all content we provide are owned by us or our licensors and are protected by law. Except for the limited license in Section 1, no rights are granted to you.
10. CHANGES AND AVAILABILITY
Features may change, be suspended, or be discontinued at any time without notice. We may update these Terms from time to time; continued use after updates constitutes acceptance. The App may experience errors, crashes, or failed traces; we do not guarantee uninterrupted or error-free operation.
11. IN-APP PURCHASES AND SUBSCRIPTIONS
Premium features are offered through an auto-renewing subscription. Prices, billing periods, and any free trial are disclosed in the App and on the App Store before purchase.
Payment is charged to your Apple ID at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours prior to the end of that period. You can manage or cancel your subscription in your Apple ID account settings. Any unused portion of a free trial is forfeited when you purchase a subscription.
All payments are processed by Apple under the Apple Media Services Terms and Conditions. We do not process payments and cannot issue refunds; refund requests must be made to Apple. Unless required by law, purchases are final.
12. WARRANTY DISCLAIMER
To the maximum extent permitted by law, the App and all traces, arcs, detections, estimates, and outputs are provided "AS IS" and "AS AVAILABLE." We and our suppliers disclaim all warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that the App will detect the ball in any given video, produce an accurate trace, correctly identify the landing point, or work with any particular device, camera, frame rate, or footage.
13. LIMITATION OF LIABILITY
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; for lost profits, lost data, lost or corrupted video footage, or loss of content; or for decisions, claims, or disputes arising from your use of the App's output, including any dispute over distance, shot outcome, or performance.
Our total liability for any claim arising out of or relating to the App will not exceed the greater of the amount you paid us for the App in the twelve (12) months before the claim or USD $25. Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the fullest extent permitted.
14. INDEMNIFICATION
You will defend, indemnify, and hold us harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your User Content, your violation of these Terms, or your violation of any law or third-party rights - including any claim brought by a person appearing in footage you recorded, traced, or shared.
15. TERMINATION
You may stop using the App at any time by deleting it. We may suspend or terminate your access if you violate these Terms. Upon termination, your license ends and you must cease use; the sections intended to survive will survive.
16. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of [YOUR JURISDICTION], without regard to conflict-of-laws rules. Any dispute will be resolved exclusively in the courts located in [YOUR VENUE], unless your local law requires otherwise. Nothing in this section deprives a consumer of the protection of mandatory provisions of the law of the country in which they reside.
17. SEVERABILITY AND ENTIRE AGREEMENT
If any provision is found unenforceable, the remaining provisions remain in full force. These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the App.

Do not rely on the App's output for equipment decisions, coaching, competition, scoring, or wagering.
